Please read carefully. These Terms of Service ("Terms") form a binding agreement between you (or the organization you represent) and ServiceVision regarding your use of the FireProof platform. By creating an account or using the Service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using FireProof (the "Service"), you agree to be bound by these Terms. If you are using FireProof on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
If you do not agree to these Terms, you may not use the Service. Users under the age of 18 may only use the Service under the supervision of a parent or legal guardian who agrees to these Terms.
2. The Service
FireProof provides a cloud-based platform for fire extinguisher inspection tracking, compliance management, and record-keeping ("Service"), including:
- A web-based administration and reporting dashboard
- Native iOS and Android mobile applications for field inspectors
- APIs for data access and integration
- Customer portal functionality for sharing compliance records with clients
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable advance notice of material changes that negatively affect your use of the Service.
3. Accounts and Access
Registration
To use FireProof, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
Organization Accounts
FireProof is a multi-tenant platform. As a tenant administrator, you are responsible for managing user accounts within your organization, including assigning appropriate roles and revoking access when users leave your organization.
Security
You must promptly notify us at security@fireproofapp.com if you suspect any unauthorized access to your account. We are not liable for any loss resulting from unauthorized account access caused by your failure to safeguard your credentials.
4. Billing and Payment
Subscription Plans
FireProof is offered on a subscription basis. Pricing is based on your extinguisher inventory size as described on our pricing page. All plans include a 30-day free trial for new accounts.
Payment
Subscriptions are billed monthly or annually in advance. Payment is due at the start of each billing period. You authorize us to charge your payment method on file for all applicable fees.
Free Trial
Your 30-day free trial begins on the date you create your account. No credit card is required to start a trial. At the end of the trial period, you must subscribe to continue using the Service. We will notify you before your trial ends.
Cancellation and Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will not be charged for the next period. We do not provide prorated refunds for partial billing periods, except where required by law.
Price Changes
We will provide at least 30 days written notice before any price increase. Price changes take effect at your next billing renewal after the notice period.
5. Acceptable Use
You agree to use FireProof only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service to store, transmit, or process data that violates any law or infringes any rights
- Attempt to gain unauthorized access to any part of the Service or another tenant's data
- Reverse engineer, decompile, or disassemble any portion of the Service
- Use automated means (bots, scrapers) to access the Service in a manner that exceeds reasonable human use
- Transmit viruses, malware, or any code designed to disrupt the Service
- Misrepresent your identity, affiliation, or authority to bind an organization
- Share your account credentials with people outside your organization
- Use the Service to store or process data unrelated to fire safety compliance management
Violation of this section may result in immediate account suspension or termination.
6. Data Ownership and Portability
Your Data Belongs to You
All inspection records, extinguisher inventory data, and compliance documents you create in FireProof belong to you and your organization. We claim no ownership over your compliance data.
License to Operate the Service
By submitting data to FireProof, you grant us a limited, non-exclusive license to process, store, and transmit your data solely to provide the Service as described in these Terms and our Privacy Policy.
Data Export
You may export your data at any time from the FireProof admin dashboard in CSV and PDF formats. If you require a full data export in a machine-readable format, contact support@fireproofapp.com.
Data After Termination
After account termination, we retain your inspection data for 7 years as described in our Privacy Policy. You may request earlier deletion subject to applicable compliance record-keeping requirements.
7. Intellectual Property
FireProof, its design, features, and underlying software are the intellectual property of ServiceVision. These Terms do not transfer any ownership of our intellectual property to you. You receive only the limited right to use the Service as described herein.
If you provide feedback, suggestions, or ideas about FireProof, you grant us a perpetual, royalty-free license to use that feedback to improve the Service.
8. Confidentiality
Each party agrees to keep the other's confidential information — including pricing, technical documentation shared during enterprise sales, and non-public product details — confidential and not to disclose it to third parties without prior written consent. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEVISION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of security vulnerabilities. FireProof is a compliance management tool — it does not replace the judgment of qualified fire safety professionals, and we make no warranty that use of FireProof will ensure regulatory compliance or prevent fire safety incidents.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICEVISION AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages — in those jurisdictions, the above limitations apply to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless ServiceVision and its officers, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) any claim by a third party arising from your inspection data or compliance records.
12. Termination
By You
You may terminate your account at any time by contacting support@fireproofapp.com or through the account settings page. Termination takes effect at the end of your current billing period.
By Us
We may suspend or terminate your account immediately if you violate these Terms or if we determine that continued access poses a security risk. We will provide notice where reasonably possible. For non-payment, we will provide 7 days notice before suspension.
Effect of Termination
Upon termination, your right to access the Service ends immediately. Data retention after termination is governed by our Privacy Policy.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Kansas, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Johnson County, Kansas, and you consent to personal jurisdiction in those courts.
Before initiating any formal dispute, the parties agree to attempt good-faith resolution through direct negotiation for at least 30 days.
14. Changes to These Terms
We may update these Terms from time to time. We will provide at least 30 days written notice of material changes by email. Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree to the revised Terms, you may cancel your subscription before the effective date.
